These Terms of Service (“Terms”) form a binding contract between you and Last Art Club LLC, a Utah limited liability company (“Last Art Club,” “we,” “us,” or “our”). By accessing or using lastartclub.com (“the Platform”), you agree to be bound by these Terms. Continued use after any update constitutes acceptance of the revised Terms.
You must be at least 13 years old to use the Platform. If you are between 13 and 17, a parent or legal guardian must consent to your use. By using the Platform you represent that you meet these requirements. The Platform is invite-only; access to submit or become a member is not guaranteed and may be revoked at any time.
Member accounts use email and password authentication after your work is accepted. You are responsible for all activity that occurs under your account. Administrators may suspend or terminate accounts for violations of these Terms at their sole discretion.
When you submit artwork or subscribe to our newsletter, you agree to receive email from Last Art Club, including transactional messages (submission confirmations, review decisions, scheduling) and marketing messages (newsletters, weekly recaps, and platform announcements).
You may opt out of marketing emails at any time by contacting info@lastartclub.com. Opting out of marketing does not affect transactional emails needed to operate the Platform. Submitting artwork after opting out constitutes renewed consent to marketing emails unless you opt out again.
Submitting artwork to the Platform does not transfer copyright or any other ownership rights to Last Art Club LLC. Artists retain full ownership of their original works at all times.
By submitting artwork, you grant Last Art Club LLC a non-exclusive, royalty-free, worldwide, sublicensable license to display, reproduce, and distribute your work solely to:
This license does not permit: commercial sale of your artwork (prints, merchandise, third-party licensing) without a separate written agreement; modification, cropping, or alteration of your artwork without your written consent; or use of your artwork in contexts unrelated to promoting Last Art Club.
You may request removal of your artwork and account at any time by contacting us at info@lastartclub.com. Upon confirmation, your artwork will be removed from active display within 30 days and Last Art Club LLC will cease new marketing use of that work. Existing published materials (e.g. past social media posts, archived press kits, cached pages) are not retroactively removed, as they may be outside the Platform's direct control.

Administrators may reject, remove, or flag any submission at their discretion without explanation. Repeated violations may result in account suspension.
The Platform anticipates introducing advertising, donation features, and art contests with entry fees (Last Art Club LLC will retain a portion of each contest entry fee as described in contest-specific rules). Before these features become active, users will be notified of updated Terms and given a 30-day review period. Separate contest rules will be posted at the time of each contest.
The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. Last Art Club LLC does not warrant uninterrupted uptime, error-free operation, or that submitted artwork will be featured or retained indefinitely.
To the maximum extent permitted by law, Last Art Club LLC's total liability arising from or related to these Terms or the Platform is capped at the greater of $100 USD or the total amounts paid by you to Last Art Club LLC in the 12 months preceding the claim. Last Art Club LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or reputational harm, even if advised of the possibility.
You agree to indemnify, defend, and hold harmless Last Art Club LLC and its officers, members, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your submitted content; (b) your use of the Platform; or (c) your violation of these Terms.
Before filing any formal dispute, the claiming party must provide 30 days' written notice to the other and attempt good-faith resolution.
If informal resolution fails, disputes are resolved through binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, seated in Utah. Each party bears its own costs unless the arbitrator finds a claim frivolous.
You waive the right to participate in class action lawsuits or class-wide arbitration. All disputes are resolved individually.
Either party may bring an individual claim in a Utah small claims court for qualifying matters.
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Material changes are communicated via email or a prominent notice on the Platform at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
